PROCESSING OF PERSONAL DATA - Information pursuant to art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council, dated 27 April 2016, relating to the protection of natural persons with regard to the processing of personal data, as well as the free movement of such data.

Dear user,

in compliance with the art. 13 of Regulation (EU) 2016/679 (hereinafter "Regulation"), we wish to inform you that the company Rizzardi Srl, as "Data Controller" of the processing, provides you with some information regarding the use of your personal data.

The processing of data concerning you will be based on the principles of correctness, lawfulness and transparency of your privacy and your rights. We therefore invite you to read the following information. 
First of all, we specify that this information describes the management methods of the website www.rizzardiyachts.com and not of other external websites that may be consulted by the user via links. The fact that Rizzardi Srl can provide these links does not imply approval of the sites themselves, for the quality, content and graphics of which Rizzardi Srl declines all responsibility. 
Furthermore, the latter is not responsible for the information obtained by the User through access to linked websites , therefore the owners of the aforementioned sites accessed are to be held responsible for the completeness and accuracy of the information.

Furthermore, Rizzardi Srl does not offer any guarantee on the software that may be present on the aforementioned external sites and cannot guarantee its quality, download safety and/or safety and compatibility with the systems in use. Any 
data provided will be processed by Rizzardi Srl only following the acquisition of your specific and distinct consent, except in the cases referred to in art. 24, of Legislative Decree 196/03.

Rizzardi Srl, pursuant to recital 48 of the Regulation, declares to have a legitimate interest in having the data provided circulate and be transferred to other companies belonging to the same business group, for internal administrative purposes.

Article 2 - Type and nature of the data processed

"Personal data" means all information by which the User can be personally identified and includes, by way of example but not limited to: name, surname, address, landline or mobile telephone number, address e-mail and all other data freely provided by the same.

The privacy policy of Rizzardi Srl regulates the processing of the User's personal data including, by way of example and not limited to, the collection, use, storage of information provided and/or collected by the User for the purposes set out below indicated.

Article 3 - Purpose of processing and legal basis

The data you spontaneously and possibly provide by completing the appropriate formats/forms will be processed within the limits of data protection legislation, for the following purposes:

billing and customer data storage;

  • registration and management of the User's access, where applicable, to the website www.rizzardiyachts.com;
  • use of the contents and services present on the aforementioned site;
  • execution of the purchase order placed by you and simplification of subsequent and possible purchase procedures;
  • preparation of statistical and market studies and research;
  • respond and satisfy every user request and for any communications of a technical/organizational nature;
  • detection of the degree of user satisfaction;
  • purposes deriving from legal obligations, regulations, community legislation, provisions issued by authorities legitimated by law or by supervisory and control bodies;
  • subject to the express and separate consent of the User, for the sending of informative and promotional communications, including of a commercial nature, as well as advertising material and/or offers of goods and services by post, internet, telephone, e-mail, MMS , SMS, social networks, by Rizzardi Srl or by natural or legal persons who collaborate with the latter and/or by other companies controlled and/or connected to the same;
  • subject to the express and separate consent of the User, for carrying out profiling activities, such as the analysis of habits or purchasing choices.

Article 4 - Methods of data processing and storage

In relation to the indicated purposes, the processing of your personal data will be carried out in an automated and/or manual form, as well as in paper form, or via IT and telematic media for the time strictly necessary to achieve the aforementioned purposes.

The processing will be carried out with methods and tools aimed at guaranteeing maximum security and confidentiality, by persons specifically appointed for this purpose, in compliance with the provisions of the articles. 31 et seq. of Legislative Decree 196/03. The data will be stored for a period not exceeding the purposes for which they were collected and subsequently processed, in relation to each type of processing. By way of example, reserving further clarifications for separate information, for the execution of sales contracts the data will be retained for the time strictly necessary for the execution of the contract and the protection of the respective contractual positions, in compliance with tax and civil legislation, also in terms of prescription of rights that have their source in the contract. In the case of complaints, however, the data will be kept for the time necessary to define the complaint and the possible exercise of the right of defense, in judicial and/or out-of-court proceedings. Furthermore, in the case of other requests with the provision of personal data (by filling in the appropriate formats) for the provision of certain services, information on the products and services offered on the site, the data will be processed for the time strictly necessary to manage the request and provide feedback to the requester. After these terms, the data will be deleted or transformed into anonymous form, unless their further conservation is necessary to fulfill legal obligations or to fulfill orders given by Public Authorities and/or Supervisory Bodies.

Article 5 - Source and provision of personal data

The personal data held by Rizzardi Srl are provided by the User who voluntarily interacts with the website www.rizzardiyachts.com, providing their personal data (by completing the appropriate forms, where included on the site) for the provision of certain services and services offered, including, by way of example, the sale of goods offered for sale.

The provision of the user's personal data is optional, although functional to the provision of certain services, including sales. In these cases, therefore, failure to provide data may compromise or make impossible the sale and/or provision of the service for which they are provided.

The optional, explicit and voluntary sending of e-mails to the addresses indicated on the website www.rizzardiyachts.com involves the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message.

Specific summary information will be progressively reported or displayed on the pages of the site set up for particular services on request.

Article 6 - Communication and dissemination of data

The personal data provided by you, subject to processing, acquired according to the methods set out in point 5 above may be communicated by Rizzardi Srl to subjects specifically appointed as Data Processors for the purposes indicated in point 3, as well as to other external subjects who collaborate with Rizzardi Srl to carry out the services requested by the User, technical, support and corporate control tasks (for example legal, IT services, shipping).

The data thus acquired will be processed by Rizzardi Srl through its own representatives belonging to the marketing or commercial, administration, IT system and programming, quality control, customer care and logistics areas, in relation to the specific purpose to be achieved and compatibly with the consents and the requests of the interested party. 
Therefore, to pursue the aforementioned purposes Rizzardi Srl also needs to communicate the User's data to external parties belonging to the following categories:

  • subjects who carry out banking, financial and/or insurance services, including subjects who intervene in the management of payment systems;
  • subjects to whom the Company offers or sells products and/or services;
  • subjects who provide services for the management of the Company's information system and telecommunications networks (including e-mail);
  • service companies for the acquisition, recording and processing of data coming from documents, or media supplied and originating from the customers themselves and having as their object processing relating to payments, checks and other securities;
  • subjects who carry out transmission, enveloping, transport and sorting of communications with customers, including the use of instant communication channels such as electronic mail, SMS and MMS, social networks, or urgent communication channels such as telegrams, including by telephone dictation , and fax;
  • subjects who carry out archiving activities of documentation relating to relationships with customers;
  • subjects who carry out customer assistance activities (e.g. call centers, help desks, etc.);
  • management company of national and international systems for the control of fraud against banks and financial intermediaries;
  • debt collection companies;
  • subjects who carry out administrative, accounting, commercial and logistics activities on behalf of Rizzardi Srl;
  • law firms or companies in the context of legal assistance and consultancy relationships;
  • subjects who carry out control, audit and certification obligations of the activities carried out by the Company also in the interests of customers;
  • subjects who carry out marketing activities, market research or contribute to the promotion of the Company's or third party products.

The same data may also be communicated to third parties and/or disclosed solely for the purpose of carrying out the service or provision requested and are communicated to third parties only in cases where:

  • this is necessary for the fulfillment of the requests made by the User (e.g. mailing list, answers to questions, notices and newsletters, deeds and measures, shipping service of the requested documentation, processing of the purchase order, etc.);
  • the communication is required by legal or regulatory obligations;
  • during legal proceedings.

The subjects belonging to the aforementioned categories perform the function of Data Processor or operate in total autonomy as separate Data Controllers.

The list of these subjects is available from the Owner and can be requested via e-mail to: info@rizzardiyachts.com, as well as at the other contact points of the Data Protection Officer.

Article 7 - Rights of the interested party

Pursuant to articles 15 to 22, the Regulation gives interested parties the possibility to exercise specific rights, in particular:

  • the interested party can obtain:
    1. confirmation of the existence of processing of personal data concerning him and, in this case, access to such data;
    2. the rectification of inaccurate personal data and the integration of incomplete personal data;
    3. the deletion of personal data concerning him, in cases where this is permitted by the Regulation;
    4. the limitation of processing, in the cases provided for by the Regulation;
    5. the communication, to the recipients to whom the personal data have been transmitted, of requests for rectification/deletion of personal data and limitation of processing received by the interested party, unless this proves impossible or involves a disproportionate effort;
    6. data portability, i.e. the reception, in a structured format, commonly used and readable by automatic device, of the personal data provided to the Data Controller, as well as the transmission of the same to another data controller, and this at any time, also to the termination of any relationships held with the Data Controller.
  • The interested party also has the right to object at any time to the processing of personal data concerning him/her: in such cases, the Data Controller is required to refrain from any further processing, without prejudice to the hypotheses permitted by the Regulation.
  • Furthermore, the interested party has the right not to be subjected to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her, unless such decision:
    1. is necessary for the conclusion or execution of a contract between the interested party and the owner;
    2. is authorized by Union or Member State law to which the Data Controller is subject;
    3. is based on the explicit consent of the interested party.

In the cases referred to in the aforementioned letters g) and i), the interested party has the right to obtain human intervention from the Data Controller, to express his or her opinion and to contest the decision;

  • the interested party also has the right:
    1. l) if you have given your consent with respect to the processing of your personal data in relation to certain purposes, to revoke the consent already expressed at any time, without prejudice to the fact that the processing carried out up to that point by the Data Controller remains lawful;

Article 10 - Express consent

By reading this information, by checking the consent box, where required, the Customer gives his express consent to the processing and communication of his personal data for the purposes and in the manner described in the previous points. This consent is recorded in the Rizzardi Srl systems and may be revoked by the Customer at any time according to the methods set out in point 11 below.

Article 8 - Navigation data - Log files

The computer systems and applications dedicated to the operation of this website detect, during their normal operation, some data (the transmission of which is implicit in the use of Internet communication protocols) not associated with directly identifiable Users.

The data collected includes the IP addresses and domain names of the computers used by the Users who connect to the site, the addresses in URI (Uniform Resource Identifier) notation of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters regarding the operating system and the IT environment used by the User. These data will be processed, for the time strictly necessary, for the sole purpose of obtaining anonymous statistical information on the use of the site, as well as to check its regular functioning.

Article 9 - Cookies

The software applications used may contain "cookie" technology. Cookies mainly have the function of facilitating navigation by the user. Cookies may provide information on navigation within the Site and allow the operation of some services that require identification of the user's path through different pages of the Site. For any access to the portal regardless of the presence of a cookie, the type of browser (e.g. Internet Explorer, Google Chrome, Firefox), operating system (e.g. Macintosh, Windows), host and URL from which the visitor came, as well as data on the requested page. However, the user has the opportunity to set their browser to be informed when they receive a cookie and thus decide to delete it. Further information on cookies can be found on the browser websites.

Article 11 - Revocation of consent to processing

The User has the right to revoke consent to the processing of his personal data by sending a registered letter with return receipt to the following address: Rizzardi Srl, Sabaudia (LT), at Via Migliara 51, 212, post code 04016, or, alternatively, a certified email to the following address: rizzardisrl@pec.it. All accompanied by a photocopy of your identity document.

At the end of this operation, your personal data will be removed from the archives as soon as possible.
